General Moshe Yaalon cancels London trip after arrest fear over Gaza bombing

The Israeli Deputy Prime Minister has been forced to cancel a fundraising trip to London after lawyers warned that he could be arrested in connection with a deadly attack he authorised in the Gaza Strip seven years ago.

The warning to reservist General Moshe Yaalon, a former head of the army, came a week after a visit to Britain by Ehud Barak, the Defence Minister, was overshadowed by an attempt by a pro-Palestinian group to obtain a British arrest warrant for alleged war crimes committed in the Gaza conflict this year.

While Mr Barak, also a former general, managed to complete his visit to London after the court delayed any immediate decision, Mr Yaalon, a member of Binyamin Netanyahu’s Likud Party, was advised by government lawyers that he could face arrest and cancelled the scheduled visit. He had been due to attend a fundraising dinner for Israeli soldiers, according to reports.

The incident that triggered the warning was a 2002 operation in which Israeli jets dropped a massive bomb on the Gaza home of Salah Shehadeh, a prominent Hamas militant leader. The blast killed 14 civilians, including the wanted man’s wife and nine children.

International lawsuits are causing increasing alarm among senior Israeli officials involved with the country’s military or security apparatus. In 2005 Doron Almog, a former general who was once in charge of the Gaza Strip, was forced to stay inside his aircraft at Heathrow after being tipped off that British police were waiting to arrest him on charges relating to the large-scale destruction of Palestinian homes near the Israeli-controlled border with Egypt.

Two years later Avi Dichter, the Public Security Minister, and a former head of the Israeli internal security organisation, the Shin Bet, turned down an invitation to Britain for fear of arrest for his part in the Shehadeh killing.

Such concerns have risen after a UN human rights inquiry last month into the recent Gaza war found both Israel and Hamas guilty of war crimes — a ruling that infuriated Israeli leaders, who warned that no peace deal would be possible with the Palestinians if the findings were endorsed.

Avigdor Lieberman, the ultra-nationalist Foreign Minister, estimated last week that there could be as many as 1,000 lawsuits worldwide pending against Israeli army officers or members of the security establishment.

“This is a campaign to delegitimise Israel,” Mr Yaalon said in a statement yesterday.

Pro-Palestinian groups, frustrated at the lack of any concrete results from UN resolutions or other international rulings, have increasingly taken to lodging private lawsuits. Under pressure from Israel and the United States, the Palestinian Authority — which runs the West Bank — has delayed endorsing the latest UN report.

That delay provoked a protest by hundreds of demonstrators in the main West Bank city of Ramallah yesterday. In Gaza, Ismail Haniya, the Hamas leader, called the decision to postpone any action on the report as “absurd and criminal”.

The war, in which more than 1,000 Palestinians were killed, including many civilians, was Israel’s attempt to stamp out years of Hamas rocket fire into its southern towns.

Mr Haniya said that such inaction on the report would further slow efforts to reconcile Fatah, the secular group that dominates the Palestinian Authority, and Hamas, the hardline Islamist faction that took control of Gaza by force in 2007.

EU lawyers draw up list of IDF officers suspected of Gaza war crimes

Human rights lawyers and pro-Palestinian activists in a number of European countries hold lists with names of Israel Defense Forces soldiers allegedly linked to war crimes committed during Operation Cast Lead in the Gaza Strip. Existing legislation enables arrest warrants to be issued against these officers if they enter those countries.

Lawyers in Britain and other European countries have been collecting testimonies of Palestinians and other data from Gaza since January, which they maintain proves that war crimes were committed by the IDF during the offensive. The evidence is linked to IDF officers holding ranks of battalion commander and higher, who were in command during various stages of Cast Lead.

The other nations who have lawyers collecting information on the matter include the Netherlands, Spain, Belgium and Norway, whose laws, as well as Britain's, allow the issuance of arrest warrants against foreign citizens suspected of war crimes.

Attorney Daniel Makover from London is coordinating the efforts in Britain. One of his colleagues visited the Gaza Strip several weeks after the fighting in order to collect testimonies. Palestinians civilians also gave the legal assistant their approval, and asked that he file the suits in their name, in line with British law.

Speaking to Haaretz, Makover refused to offer details on the identity of the IDF officers or how many were listed, but said that much depends on the specific details of each case. Makover said that anyone who was involved in an incident may face criminal charges. The attorney added that there are officers who are obviously candidates for charges, and others who are less obvious, but emphasized that it depends on the facts collected on the ground.

Makover said that the Goldstone report on the fighting in the Gaza Strip will bolster the efforts of the activists, and said that some of the instances mentioned in the report were already known to the attorneys. Makover is part of an unofficial network of attorneys operating in various countries in Europe, exchanging and sharing information so that suspected officers may be arrested in those countries.

The information is often received from pro-Palestinian activists who follow Jewish or pro-Israel groups that invite IDF officers to deliver lectures. In some instances, this information is relayed to border controls. Makover said that a small number of names of IDF officers is already on a British police watch list, and that when they arrive in Britain the authorities will issue an arrest warrant that will lead to their possible detention.

A number of human rights groups are busy working to create an international organization that would enable closer surveillance of those they suspect of war crimes and torture, as well as seek warrants for their arrest.

The IDF did not wish to specify the instructions it has given to officers before they travel abroad. In practice, many of the officers who participated in the Gaza operation have been asked to consult with legal experts at the Foreign Ministry, where they are instructed how to behave abroad and where they need to lower the profile of their identity; in some cases they are advised not to visit certain countries.

The Foreign Ministry released a statement saying: "The ministry is aware of efforts undertaken by Palestinian groups and their supporters to harm IDF officers through legal and public relations means, and is working to prevent such efforts."

Livni reportedly cancels U.K. visit, fearing arrest

Opposition leader Tzipi Livni on Monday canceled her participation in a Jewish function in London, fearing a possible arrest over her part in last winter's Israel's Gaza offensive, the London-based Arabic daily Al-Quds Al-Arabi reported on Monday.

The report claimed that the Scotland Yard had advised the organizers of the Jewish National Fund conference in Hendon, on the British capital's northwest side, that the former foreign minister had canceled her scheduled address to the assembly over threats of a possible lawsuit by pro-Palestinian groups.

The Al-Quds Al-Arabi report also said that a group of about 100 anti-Israel protesters rallied outside the Hendon Hall Hotel on Sunday, just as delegates arrived at the JNF meet.

Livni's office said in a statement following the report that her appearance at the London event was canceled two weeks ago due to a scheduling conflict.

Livni's office also said that the opposition leader was proud of all the decisions she made during the Gaza war, an operation which she said achieved its goal of bring security to Israel.

A United Kingdom court two months ago deferred until further notice an appeal by local pro-Palestinian groups to issue an arrest warrant against visiting Defense Minister Ehud Barak.

A similar appeal was issued in 2004 against Israel's then defense minister, Shaul Mofaz. At the time, Mofaz was granted immunity from international arrest and trial - a precedent set by the British court, which until then had given such protection only to foreign ministers or premiers

Peres: Livni arrest warrant one of Britain's biggest mistakes

President Shimon Peres said on Wednesday that the arrest warrant issued against opposition leader Tzipi Livni in Britain was one of the country's biggest political mistakes in recent years.

Israel's government confirmed on Tuesday that Livni canceled a planned London trip this month after her office received news of a secretly issued arrest warrant awaiting her arrival.

Peres said before heading for the Copenhagen climate conference to represent Israel, that London has pledged to remedy this situation, and it is high time they did it.

Britain pledged Tuesday to reform the peculiar legal power that lets judges order the arrest of visiting politicians and generals - a threat currently focused on Israeli visitors that, one day, might be invoked against Barack Obama or Vladimir Putin.

Lawyers working with Palestinian activists in recent years have sought the arrest of senior Israeli civilian and military figures under terms of universal jurisdiction. This ill-defined legal concept empowers judges to issue arrest warrants for visiting officials accused of war crimes in a foreign conflict.

Their latest target is Tzipi Livni, Israel's former foreign minister and current opposition leader, who staunchly defends Israel's offensive against Hamas in the Gaza Strip.


Foreign Secretary David Miliband later announced that Britain would no longer tolerate legal harassment of Israeli officials in this fashion.


Speaking after meeting Israel's London ambassador Tuesday night, Miliband said the British law permitting judges to issue arrest warrants against foreign dignitaries without any prior knowledge or advice by a prosecutor must be reviewed and reformed.

Miliband said the British government was determined that arrest threats against visitors of Livni's stature would not happen again.

"Israel is a strategic partner and a close friend of the United Kingdom. We are determined to protect and develop these ties," Miliband said. "Israeli leaders - like leaders from other countries - must be able to visit and have a proper dialogue with the British government."

Miliband voices shock over arrest warrant in call to Livni

Earlier Tuesday, Miliband called Livni to express his shock over the arrest warrant and pledged to address the matter immediately.

Livni clarified that she doesn't view the arrest warrant as a personal offense, but rather one that affects Israel as a whole. She added that it also harms efforts to operate jointly against threatening elements.

Livni stressed that Israel and Britain must work to solve the problem according to agreements outlined when she was foreign minister.

Miliband earlier in the day denounced the arrest warrant as insufferable, after Israel warned that the matter could harm bilateral ties.

Miliband made the comments during a meeting with Israel's ambassador to Court of St. James, Ron Prosor. The Israeli envoy asked to discuss the matter with Miliband on Monday, following news that Livni had canceled her trip to Britain after a warrant was issued for her arrest.

Prosor told Miliband that the British government must work immediately to combat the grave phenomenon of arrest warrants being issued against senior Israeli officials.

The foreign secretary said he had spoken with British Prime Minister Gordon Brown and with Secretary of State for Justice Jack Straw in order to try to resolve the problem.

Miliband called Foreign Minister Avigdor Lieberman on Tuesday and expressed concern over the arrest warrant, saying he and other British parliamentarians found it unacceptable. Miliband also planned to call Livni.

He told Lieberman that solutions must be found in order to prevent this situation from repeating itself in the future.

Lieberman expressed disappointment over Britain's abstention during the United Nations vote on the Goldstone report, which accuses Israel and Hamas of committing war crimes in Gaza, and the Swedish proposal to recognize Jerusalem as a shared Israeli and Palestinian capital.

Also Tuesday, the Foreign Ministry summoned the British envoy to Israel to rebuke him over the warrant.

Israel views the arrest warrant with utmost gravity, Naor Gilon, deputy director at the Foreign Ministry in charge of Western Europe, told British ambassador Tom Phillips.

Gilon also called on Phillips to urge his government to change the law that allows for arrest warrants to be issued against senior Israeli officials over alleged war crimes perpetrated in Gaza during the winter conflict between Israel and Hamas.

Netanyahu: We won't allow our leaders to be tried for war crimes

Prime Minister Benjamin Netanyahu on Tuesday issued a statement saying that Israel will not agree to have its leaders be recognized as war criminals.

"We will not agree to a situation in which Ehud Olmert, Ehud Barak and Tzipi Livni will be summoned to the defendant's bench," Netanyahu said.

"We will not agree that IDF commanders and soldiers, who - heroically and in a moral fashion - defended our citizens against a brutal and criminal enemy, will be condemned as war criminals. We reject this absurdity outright."

Netanyahu instructed National Security Adviser Prof. Uzi Arad to deliver a clear message on this issue to British envoy Phillips.

Dr. Arad spoke with Ambassador Phillips and made it clear to him that Israel expects the British government to act against this immoral phenomenon, which is trying to impair Israel's right to self-defense.

A statement from the British embassy in Israel said the U.K. is determined to work for peace in the Middle East and to be a strategic partner to Israel.

"To do this, Israel's leaders need to be able to come to the U.K. for talks with the British government. We are looking urgently at the implications of this case." The embassy statement said.

Israel's Foreign Ministry earlier Tuesday called on the British government to end the "absurd situation" in which arrest warrants were being issued to Israeli officials over alleged war crimes in Gaza, warning that ties between the two countries could suffer as a result.

"Only actions can put an end to this absurd situation, which would have seemed a comedy of errors were it not so serious," said the Foreign Ministry.

The ministry warned that in indulging the arrest warrant, the British government was hampering its own efforts at playing a role in Middle East peace negotiations.

"We appreciate the British government's desire to play a central role in the Middle East peace process, and thus we expected it to translate the importance it gives its relations with Israel into actions," said the ministry.

"Israel urges the British government to once and for all honor its promises to take action to prevent anti-Israel forces from exploiting the British legal system to act against Israel and its citizens, the ministry said. The absence of resolute and immediate action to redress this distortion harms relations between the two countries," it added.

Vice Premier Silvan Shalom urged the ministry to make "real diplomatic" efforts to make it clear that Israel would not accept such behavior.

"We are all Tzipi Livni," he said. "The time has come for us to move from the defensive to the offensive. We must use real diplomacy here, to tell Britain, Spain and all those other states that we will not stand for this anymore."

Livni: World can judge us, but don't equate IDF with terrorist

In response to the warrant, Livni said Tuesday that she would not accept any accusation that compared Israel Defense Forces soldiers to terrorists.

"I have no problem with the fact that the world wants to judge Israel," said Livni. "We are part of the free world. The problem starts when they equate terrorists and Israeli soldiers."

Senior officials in Israel confirmed reports on Monday that a British court issued the warrant against Livni for her role in orchestrating Israel's military offensive against Hamas in the Gaza Strip nearly a year ago. The request for the warrant was submitted by a pro-Palestinian organization.

British sources reported late Monday that though a British court had issued an arrest warrant for Livni over war crimes allegedly committed in Gaza while she served as foreign minister, it annulled it upon discovering she was not in the U.K.

The incident was the latest in a string of attempts by pro-Palestinian activists to have Israeli officials arrested.

Pro-Palestinian lawyers attempted earlier this year to invoke the universal jurisdiction law to arrest Gaza war mastermind Ehud Barak, Israel's defense minister, but his status as a Cabinet minister gave him diplomatic immunity.

In 2005, a retired Israeli general, Doron Almog, returned to Israel immediately after landing in London because he was tipped off that British police planned to arrest him. The warrant against Almog - who oversaw the bombing of a Gaza home in which 14 people were killed - was later canceled.

Other Israeli leaders, including former military chief Moshe Ya'alon and ex-internal security chief Avi Dichter, have also canceled trips to Britain in recent years for the same reason.

Tzipi Livni arrest warrant prompts Israeli government travel 'ban'

Israel hit back at Britain today over the arrest warrant issued for former foreign minister Tzipi Livni for alleged war crimes, warning that until the matter was resolved senior officials would not be visiting the UK.

Israelis prime minister, Binyamin Netanyahu, called the warrant absurd, the Ynet website reported.

The British ambassador, Tom Phillips, was summoned to the foreign ministry in Jerusalem where a senior Israeli official told him the row over Livni meant that Britain's ability to play a role in the Middle East peace process had been damaged.

The row erupted at the weekend when Westminster magistrates court issued an unprecedented warrant for the arrest of Livni, now leader of the opposition Kadima party, who was foreign minister and a member of the war cabinet during the Gaza offensive earlier this year.

The warrant was withdrawn amidst huge embarassment when it was discovered she was not in the UK.

The fact that it was issued in error – at the request of lawyers acting for Palestinian victims of the Gaza war – did nothing to quell Israeli anger. Israel's foreign ministry called it a cynical move, and former defence minister Shaul Mofaz urged the recall of Israel's ambassador to Britain "for consultations" in Jerusalem.

Ron Prosor, the ambassador, told Israel Army Radio: "The current situation has become intolerable, it is time that it changed. I am convinced that the British government will understand that it is time to react and not content itself with declarations."

Israeli media reported that senior government officials would not visit the UK until Britain addressed the issue.

Livni had been due to attend a conference in London but her office said she had cancelled her attendance two weeks ago. Palestinian sources claimed to have seen her at the event and alerted the lawyers who were seeking the warrant.

"The lack of determined and immediate action to correct this distortion harms the relations between the two countries," the foreign ministry said. "If Israeli leaders cannot visit Britain in a dignified manner, it will naturally be a real obstacle to Britain's desire to have an active role in the peace process in the Middle East."

It said Israel and Britain were engaged in a "common struggle against international terrorism", and that British soldiers were trying to root out terrorism on several fronts around the world.

Palestinians claim 1,400 people, mostly civilians, were killed in the three-week offensive. Israel counted 1,166 dead, the majority combatants. Israel insists it acted in self-defence against Hamas rocket attacks from Gaza.

In September, pro-Palestinian lawyers attempted to invoke "universal jurisdiction" to arrest Ehud Barak, Israel's defence minister during the war and afterwards. Barak's status as a serving cabinet minister gave him diplomatic immunity.

In 2005, a retired Israeli general, Doron Almog, returned to Israel after landing in London because he was tipped off that police planned to arrest him. The warrant for Almog – who allegedly oversaw the bombing of a Gaza building in which 14 people were killed – was later cancelled.

Other Israeli leaders, including former military chief Moshe Yaalon and ex-Shin Bet security chief Avi Dichter, have cancelled trips to Britain in recent years for the same reason.

Two IDF soldiers charged with using 9-year-old 'human shield' in Gaza war

The Israel Defense Forces prosecution on Thursday filed an indictment against two combat soldiers suspected of inappropriate conduct during Israel's offensive in the Gaza Strip in 2008.

The soldiers, who served as staff sergeants in the Givati Brigade during Operation Cast Lead, allegedly forced a 9-year-old Palestinian boy to open a number of bags they thought might contain explosive materials.

The soldiers, who breached the army's rule against using civilians as human shields during war, will be tried for violating their authority and for inappropriate conduct.

The incident in question occurred in the Tel Al-Hawa neighborhood in south Gaza City in January 2009, toward the end of the war.

IDF court releases soldier convicted of beating Palestinian

In a separate incident earlier Thursday, the military court ordered the release of Adam Malul, an IDF officer convicted in December on charges of aggravated assault and conduct unbecoming an officer after hitting a Palestinian in the West Bank.

In sentencing the officer, 1st Lt. (res.) Adam Malul of the Kfir infantry brigade, the court ruled that he had already served a sufficient punishment after spending 64 days in jail and a further 32 days under house arrest.

The court also rejected a request by the prosecution to demote Malul to the rank of private.


Malul was convicted in of hitting a man while making an arrest in the West Bank village of Kadum in September 2008.

In its December verdict, the court rejected testimony by a former commander of the Kfir infantry brigade, Col. Itai Virob, and a former commander of the Shimshon unit, Lt. Col. Shimon Harush, in which they justified hitting Palestinian detainees under exceptional circumstances.

Malul's family has said that the trial was a smear campaign against him and accused the court of scape-goating him while acquitting his superiors.

During his trial, Malul testified that he was not ashamed of hitting the Palestinian man, saying, "It was what I had to do".

However, GOC Central Command Gadi Shamni testified during the military trial that IDF soldiers were not authorized to attack Palestinian civilians during arrest raids, adding that those who cross the army's "red lines" must be put to trial.

Shamni added that the IDF never authorized the use of such aggression during questioning of detainees.

Intelligence and Atomic Energy Minister Dan Meridor cancelled on Monday a planned visit to London, England, after receiving information that he might be facing a lawsuit or an arrest warrant upon arrival.

The Foreign Ministry and the Justice Ministry notified Meridor that he may face charges connected to his alleged role in the IDF raid on the Gaza-bound ship Mavi Marmara on May 31, 2010. The Israeli raid resulted in the deaths of 9 Turkish activists. Meridor refused to comment on the cancellation.

Meridor is member of a forum of seven ministers that advises Prime Minister Benjamin Netanyahu. The forum discussed the arrival of the Gaza-bound flotilla in a meeting that took place on May 26, according to Netanyahu's testimony before a committee investigating the raid.

However, Netanyahu denied in his testimony that the forum had discussed the details of the military operation.

This is not the first case of Israeli politicians facing legal charges in Britain. In 2009, a British court issued an arrest warrant for Livni over war crimes allegedly committed in Gaza while she served as foreign minister. Livni canceled her trip to London as a result of information of the warrant issued against her.

Livni served as foreign minister alongside Prime Minister Ehud Olmert and Defense Minister Ehud Barak during the Israel Defense Forces offensive in Gaza. The three figures comprised the "troika" of top decision-makers who charted the course of the war.
